Legal metrology is the application of legal requirements to the measurements and measuring instruments. The OIML (International Organisation of Legal Metrology) is mainly to promote the global harmonisation of legal metrology which facilitates the international trade. Legal metrology concerns for the requirements of measurement and measuring the instruments for the protection of health, environment, public safety, protection of fair trade of the consumers, and enabling taxation.

Reliability and accuracy of the measurement to be ensured because measured values can affect the health, safety or the transparency of the financial transactions.

Weights and measures are held together by the words accuracy, regulatory and the reliability. The word regulatory refers the legal aspects of the term and the national metrology institutes and standards organisation creates the framework to ensure the accuracy and the reliability of the measurement.

The OIML have listed the following activities which fulfil the purpose fo legal metrology. They are as follows:

  • Legal requirements have to be set-up.
  • Assessment of controlling or conformity of regulated activities and products.
  • Supervision of regulated products and activities.
  • For the correct measurements, necessary infrastructure will be provided.

Types of licenses in legal metrology:

  • License as a manufacturer.
  • License as a dealer.
  • License as a repairer.
  • Registration as manufacturer/packer of pre-packed commodities.

Application for license as a manufacturer:

  • Trade license which has been issued by the concerned town committee/municipal corporation/board.
  • PAN/professional tax registration number/CST number/VAT/sales tax registration number.
  • Factory of the manufacturer where the premise had been established.

Documents required for license as a manufacturer:

  • No objection certificate from the owner/Rental receipt.
  • Attested copy of the sale deed/ legal title of the premises/property tax receipt.
  • List of testing equipment.
  • Copy of the constitution of the firm.
  • ID proof and address proof of the applicant.

Application for license as a dealer:

  • Authorisation letter has to be obtained from the manufacturer in order to sell weight or measure.
  • Sales tax registration number/VAT/Professional tax registration number/PAN/CST number.
  • The certificate of model approval which has been issued by the government of India.
  • Valid license of trade which has been issued by the board/municipal corporation/town committee.

Documents required for granting the dealer’s license:

  • Site plan.
  • Rental receipt or NOC from the owner.
  • Testing equipment.
  • MOA in case of private limited company or any other limited companies.
  • Tools and equipment list.
  • Factory registration certificate.
  • Legal title of the premises to be evident in one of the following ways (sale deed/lease deed/ property tax receipt/allotment letter).

Application for registration as importer/manufacturer/packer of pre-packed commodities:

  • Factory registration certificate.
  • Partnership deed, if any.
  • Address proof
  • VAT/sales tax registration number/PAN/ professional tax registration number/CST number.
  • Trade license which had been issued by the town committee/municipal corporation/board.
  • Certificate of importer which should be obtained by the ministry of commerce, Government of India.
